The Earthquake Retrofit exclusion mainly includes construction of seismic retrofitting improvements or other improvements that utilize earthquake hazard mitigation technologies on an existing building.

The property owner must file a completed Seismic Safety Construction Exclusion Form with our office prior to, or within 30 days of, completion of construction. Any additional documents needed to support the claim must be filed no later than 6 months after the completion of the project.

The exclusion only applies to existing portion of the buildings. Additions that didn’t exist previously would not qualify for the exclusion. Construction of entirely new buildings would also not qualify.

The exclusion does not include other alterations, such as new plumbing, electrical or other added finishing materials, completed during seismic related work.
